These Terms of Use ("Terms") are an agreement between you and the developer of ulTrain ("we", "us") and govern your use of the ulTrain app on iOS and Android and the ultrain.fit website. By downloading or using the app you agree to these Terms.
If you use ulTrain on an Apple device, Apple's Licensed Application End User License Agreement also applies; where it conflicts with these Terms for the iOS app, Apple's agreement takes precedence. If you use ulTrain on Android, your download and any purchases are also subject to the Google Play Terms of Service.
We grant you a personal, non-exclusive, non-transferable licence to use ulTrain on devices you own or control, for your own personal, non-commercial training. You may not copy, modify, distribute, sell, rent, reverse-engineer or attempt to extract the source code of the app, except where the law permits it despite this restriction.
ulTrain provides training planning, logging and analysis tools, including coaching-style summaries generated from your own data. It does not provide medical advice, diagnosis or treatment.
You are responsible for keeping your account credentials secure and for the accuracy of the information you enter. You can delete your account at any time - see our account deletion page. How we handle your data is described in the Privacy Policy, which forms part of these Terms.
ulTrain is free to download. Optional ulTrain Pro subscriptions (monthly or yearly, with a free trial where offered) unlock additional features.
If you submit races, events or reviews to the shared directory, you are responsible for what you post. You must not post content that is unlawful, misleading, offensive, infringes someone else's rights, or contains other people's personal information. We may moderate, edit or remove submissions and may suspend accounts that misuse the app, attempt to disrupt the service, or breach these Terms.
The app, website, ulTrain name, logo and all content we created are our property and are protected by intellectual-property law. You retain ownership of the training data and content you create; you grant us the limited licence needed to store and process it in order to run the service, as described in the Privacy Policy. If you make a race listing or review public, you grant us a licence to display it to other users.
We work to keep ulTrain available and reliable, but the service is provided "as is" and "as available", without warranties of any kind to the extent the law allows. We may add, change or withdraw features, and may update these Terms; material changes will be reflected by the "Last updated" date above and, where appropriate, notice in the app. Continued use after a change means you accept the updated Terms.
To the fullest extent permitted by law, we are not liable for indirect or consequential losses, loss of data caused by factors outside our reasonable control, or injury arising from your decision to undertake physical training. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by our negligence.
These Terms are governed by the law of England and Wales, and disputes are subject to the non-exclusive jurisdiction of its courts. If you live elsewhere, you keep the benefit of any mandatory consumer protections of your country of residence.
